Agreement to Terms

Welcome to Bitefit. By accessing or using our mobile application, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our app.

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting. Your continued use of Bitefit after changes constitutes acceptance of the modified terms.

Eligibility

You must be at least 13 years old to use Bitefit. By using our app, you represent and warrant that:

• You are at least 13 years of age
• You have the legal capacity to enter into these terms
• You will provide accurate and truthful information
• You will comply with all applicable laws and regulations

If you are under 18, you should review these terms with a parent or guardian.

Account Registration and Security

Account Creation

To use certain features of Bitefit, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access
• Be responsible for all activities that occur under your account

Account Security

You are solely responsible for maintaining the security of your account. We are not liable for any loss or damage arising from your failure to protect your account credentials.

Subscriptions and Payments

Subscription Terms

Bitefit offers subscription plans that provide access to premium features. By purchasing a subscription:

• You authorize us to charge your payment method on a recurring basis
• Subscriptions automatically renew unless cancelled before the renewal date
• Prices are subject to change with notice
• All sales are final unless otherwise required by law

Free Trials

We may offer free trial periods for certain subscription plans. Trial terms will be specified at sign-up. If you don't cancel before the trial ends, you will be charged for the subscription.

Cancellation

You can cancel your subscription at any time through your Google Play Store account settings. Cancellation takes effect at the end of the current billing period. No refunds will be provided for partial billing periods unless required by law.

Refunds

Refund requests should be directed to Google Play Store support, as all payments are processed through Google Play. We do not have the ability to issue refunds directly.

Acceptable Use

When using Bitefit, you agree NOT to:

• Violate any laws or regulations
• Infringe on intellectual property rights
• Upload malicious code, viruses, or harmful content
• Attempt to gain unauthorized access to our systems
• Reverse engineer, decompile, or disassemble the app
• Use automated systems (bots, scrapers) without permission
• Harass, abuse, or harm other users
• Impersonate others or provide false information
• Use the app for any illegal or unauthorized purpose
• Resell or redistribute our services without permission

We reserve the right to suspend or terminate accounts that violate these terms.

User Content

Your Content

You retain ownership of content you create or upload to Bitefit (food logs, photos, etc.). By submitting content, you grant us a license to use, store, and display your content solely for the purpose of providing our services.

Content Guidelines

You are responsible for your content and must ensure it does not:

• Violate any laws or third-party rights
• Contain harmful, offensive, or inappropriate material
• Include personal information of others without consent
• Promote dangerous behaviors or misinformation

Content Removal

We reserve the right to remove content that violates these terms or is otherwise objectionable, without notice.

Intellectual Property

Bitefit and all its content, features, and functionality are owned by us and are protected by copyright, trademark, and other intellectual property laws.

You may not:

• Copy, modify, or create derivative works of our app
• Use our trademarks or branding without permission
• Extract or reuse any portion of our content or code
• Remove any copyright or proprietary notices

Third-Party Services

Bitefit integrates with third-party services like Google Fit. Your use of these services is subject to their respective terms and policies. We are not responsible for:

• The availability or functionality of third-party services
• The accuracy of data from third-party sources
• Third-party privacy practices or data handling
• Changes or discontinuation of third-party integrations

Disclaimer of Warranties

Bitefit is provided "as is" and "as available" without warranties of any kind.

We do not warrant that:

• The app will be uninterrupted, secure, or error-free
• Information provided is accurate, complete, or reliable
• Defects will be corrected
• The app is free of viruses or harmful components

You use Bitefit at your own risk. We disclaim all warranties, express or implied, including warranties of merchantability and fitness for a particular purpose.

Limitation of Liability

To the fullest extent permitted by law, Bitefit and its owners, operators, and affiliates shall not be liable for any damages arising from your use of the app.

This includes, but is not limited to:

• Direct, indirect, incidental, or consequential damages
• Loss of data, profits, or business opportunities
• Personal injury or health-related issues
• Damages from unauthorized access to your account
• Damages from third-party services or integrations

In no event shall our total liability exceed the amount you paid us in the past 12 months, or $100, whichever is less.

Indemnification

You agree to defend, indemnify, and hold harmless Bitefit and its affiliates from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the app
• Your violation of these terms
• Your violation of any laws or third-party rights
• Content you submit or actions you take on the app

Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for:

• Violation of these terms
• Fraudulent or illegal activity
• Extended periods of inactivity
• Any reason we deem necessary to protect our service or users

You may terminate your account at any time by following the steps on our account deletion page.

Upon termination, your right to use Bitefit ceases immediately. Sections of these terms that by their nature should survive termination will remain in effect.

Governing Law and Disputes

These terms are governed by and construed in accordance with applicable laws, without regard to conflict of law principles.

Any disputes arising from these terms or your use of Bitefit will be resolved through binding arbitration, except where prohibited by law. You agree to waive any right to a jury trial or to participate in class action lawsuits.

Changes to Service

We reserve the right to:

• Modify, suspend, or discontinue any part of Bitefit at any time
• Change features, functionality, or pricing
• Impose limits on certain features or access

We are not liable for any modifications, suspensions, or discontinuation of the service.

Miscellaneous

Entire Agreement

These terms, together with our Privacy Policy, constitute the entire agreement between you and Bitefit.

Severability

If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force.

Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

Assignment

We may assign our rights and obligations under these terms. You may not assign your rights without our prior written consent.
